Terms and Conditions of Use

Official regulations for using the Mobcorp cloud computing platform.

BETA SERVICE NOTICE: The Mobcorp platform is currently in BETA phase. The service may contain imperfections, experience periods of unavailability, or undergo significant changes without prior notice. By using the platform, you acknowledge and accept these conditions.

These Terms of Service ("Terms") establish the rules and conditions for using the Mobcorp cloud computing platform ("Mobcorp", "we", "our"). By signing up or using our services, you agree to comply with these Terms. Any new features or tools added to the current service will also be subject to these Terms. You can review the most current version of these Terms at any time on this page.

1Account Terms

  • You must be 18 years or older, or at least the age of majority in the jurisdiction where you reside or from which you use this Service.
  • To access and use the Services, you must register a Mobcorp account by providing your full name, current address, phone number, a valid email address, and other information indicated as necessary.
  • You acknowledge that Mobcorp will use the email address provided as the primary method of communication.
  • You are responsible for maintaining the security of your password. Mobcorp will not be liable for any loss or damage resulting from your failure to maintain the security of your Account and password.
  • You are responsible for all activity and content uploaded, collected, generated, stored, or transmitted through your account.
  • A violation of any term of these conditions, as determined at the sole discretion of Mobcorp, will result in the immediate termination of your services.

2Account Activation

2.1. Mobcorp Account

  • The person who signs up for the Service will be the contracting party ("Account Owner") for these Terms and will be the person authorized to use any corresponding account.
  • If you are signing up for the Service on behalf of your employer, your employer will be the Account Owner. In these cases, you represent and warrant that you have authority to bind your employer to these Terms.

3Beta Service

Mobcorp is currently in BETA phase, which means:

  • The service is provided "as is" and "as available", without guarantees of performance or continuous operation.
  • The platform may contain errors, failures, or inaccuracies that will be corrected during development.
  • There may be periods of unscheduled downtime or temporary service interruptions.
  • Features, functionality, and prices may change significantly without prior notice during this phase.
  • We reserve the right to discontinue the service, or parts of it, at any time without prior notification.
  • Support response times may be longer than expected for production services.
  • We recommend not using the service for critical applications or storing sensitive data without adequate backups.

By using the BETA service, you acknowledge and accept these conditions and understand the inherent risks associated with using pre-release software.

4General Conditions

The following conditions apply to all users of the Mobcorp platform:

  • Technical support is provided only for paid account holders and is available only via email.
  • You may not use the Mobcorp service for any illegal or unauthorized purpose, nor violate any laws in your jurisdiction when using the Service.
  • You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without express written permission from Mobcorp.
  • You understand that your content (excluding credit card information) may be transferred unencrypted and may involve: (a) transmissions over various networks; and (b) changes to conform to the technical requirements of connecting networks or devices.
  • You acknowledge and agree that your use of the Service is governed by our privacy policy.

5Mobcorp Rights

  • We reserve the right to modify or terminate the Service for any reason, without prior notice, at any time.
  • We reserve the right to refuse service to anyone for any reason at any time.
  • We may, but have no obligation to, remove content and suspend or terminate accounts if we determine, in our sole discretion, that the content or account violates these Terms.
  • Verbal or written abuse of any kind (including threats of abuse or retaliation) against any customer, employee, member, or representative of Mobcorp will result in immediate account termination.
  • We reserve the right to provide our services to your competitors and make no promise of exclusivity in any market segment.
  • In the event of a dispute over account ownership, we reserve the right to request documentation to determine or confirm account ownership.
  • We maintain the right to determine, in our sole discretion, the legitimate ownership of the account and to transfer an account to the legitimate owner.

6Service Plans and Billing

6.1. Available Plans

Mobcorp offers different service plans to meet the varied needs of customers. Our plans include different levels of resources, computing capacity, storage, and technical support.

Complete and up-to-date details of each plan, including technical specifications and prices, are available on our pricing page. As we are in BETA phase, plan specifications and functionality may change more frequently.

Currently, we offer the following plan categories:

  • Hobby Plan: Ideal for personal projects, testing, and development.
  • Pro Plan: Designed for production projects with advanced resource needs.
  • Enterprise Plan: Customized for large-scale operations with specific requirements.

6.2. Billing

Our billing system works according to the following principles:

  • A valid credit card is required for paid accounts.
  • The Service is billed monthly based on the selected plan and the consumption of additional resources, when applicable.
  • All fees are exclusive of taxes, levies, or charges imposed by tax authorities.
  • For any upgrade or downgrade in plan level, your credit card will be charged at the new rate on your next billing cycle.
  • Downgrading your Service may cause the loss of features or capacity of your account.
  • Mobcorp does not offer refunds. Charges for the service are final and non-refundable.

7Cancellation and Termination

These are the conditions related to cancellation or termination of services:

  • You may cancel your account at any time by sending an email to support@mobcorp.cloud.
  • After termination of Services:
    • Mobcorp will cease providing the Services and you will no longer be able to access your account
    • Unless otherwise provided in the Terms of Service, you will not be entitled to refunds
    • Any outstanding balance will immediately become due and payable in full
    • Your data and servers will be deactivated and may be deleted
  • Mobcorp reserves the right to modify or terminate your account for any reason, without prior notice, at any time.
  • Fraud: Without limiting any other remedies, Mobcorp may suspend or terminate your account if we suspect that you have engaged in fraudulent activity related to the Service.

8Modifications to Service and Prices

About possible changes to our services and prices:

  • Prices for using the Services are subject to change upon 30 days' notice from Mobcorp.
  • Such notice may be provided at any time by posting the changes on the Mobcorp website or by email.
  • Mobcorp reserves the right, at any time, to modify or discontinue, temporarily or permanently, the Service (or any part of it) with or without prior notice.
  • Mobcorp will not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.
  • Given the BETA status of the service, changes may occur more frequently and with shorter notice periods during this phase.

9Third-Party Services

  • Mobcorp may recommend, provide access to, or enable applications, products, services, or links to third-party websites ("Third-Party Services").
  • These Third-Party Services are not under Mobcorp's control, and Mobcorp is not responsible for the content or operation of such Third-Party Services.
  • The availability of these Third-Party Services does not imply any endorsement by Mobcorp.
  • Use of Third-Party Services is at your own risk, and you should review the terms and privacy policies associated with such services.
  • Mobcorp provides no warranties with respect to Third-Party Services.
  • You agree to indemnify and hold Mobcorp harmless from any claim arising from your use of Third-Party Services.

10Intellectual Property

10.1. Mobcorp Rights

All intellectual property rights related to the platform, including, but not limited to, software, source code, databases, interfaces, and visual elements belong exclusively to Mobcorp.

10.2. User Content

You retain all intellectual property rights to your content stored on the platform. By using the Services, you grant Mobcorp a limited license to host, store, and display such content solely for the purpose of providing the Services.

10.3. Feedback and Suggestions

Any feedback, suggestion, or idea provided by you regarding the Services may be used by Mobcorp without any obligation to compensate you. By submitting comments, you grant Mobcorp perpetual and irrevocable rights to use and incorporate your suggestions into our services.

11Limitation of Liability

11.1. Service Warranty

The Services are provided "as is" and "as available", especially considering the BETA status. Mobcorp disclaims all warranties, express or implied, including but not limited to merchantability and fitness for a particular purpose.

11.2. Limitation of Liability

To the maximum extent permitted by law, Mobcorp's total liability for any claims under these Terms is limited to the amount paid by you for the Services in the 12 months preceding the claim.

11.3. Excluded Damages

Mobcorp will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, even if advised of the possibility of such damages.

11.4. Force Majeure

Neither party will be liable for delays or failures in performance resulting from causes beyond their reasonable control, including acts of God, natural disasters, terrorism, riots, war, or government-imposed restrictions.
